电商平台“二选一”行为一直是我国数字平台发展过程的焦点问题。由于“二选一”行为在我国监管力度较低,处于合法地位,具有线上线下融合的显著特征,并借助于我国特有的电商平台经营模式和极具地域特色的市场环境,我国电商平台“二选一”行为发展态势向好。但是,“二选一”行为的显著竞争效应,排挤竞争对手、损害消费者福利、减损经营者利益,滥用市场支配地位制度在规制电商平台“二选一”行为过程中可以发挥作用。在适用该制度的过程中,需要借助基于价格上涨的SSNDQ测试方法来界定相关市场,同时运用实质认定法并综合考虑多种因素认定市场支配地位,最后在分析电商平台“二选一”行为的反竞争性,需要结合电商平台特征,多方面考量“二选一”行为的竞争影响。The “two-choice” behavior of e-commerce platforms has consistently been a key issue in the development process of digital platforms in China. Owing to the relatively low regulatory intensity and the legal status of the “two-choice” behavior in China, it exhibits a distinct feature of integrating online and offline operations and takes advantage of the unique business model of e-commerce platforms and the highly regionalized market environment specific to China. Consequently, the “two-choice” behavior of e-commerce platforms in China is developing favorably. Nevertheless, the significant competitive effects of the “two-choice” behavior, such as excluding competitors, undermining consumer welfare, and diminishing the interests of operators, can be addressed through the regulation of the abuse of dominant market position system. In the process of applying the system, it is necessary to define the relevant market with the help of SSNDQ test based on price increase, and at the same time, apply the substantive determination method and comprehensively consider a variety of factors to determine the dominant position of the market, and finally, in analyzing the anticompetitive nature of the “two-choice” behavior of the e-commerce platform, it is necessary to combine the characteristics of the e-commerce platform, and to consider the competitive impact of the “two-choice” behavior from multiple perspectives.
