网络平台外卖已成为公众生活的一部分,随着网络平台外卖的快速发展,相关法律法规和行业标准的制定和更新相对滞后。由于平台、商家和骑手在运营过程中缺乏明确的指导和规范,从而增加了食品安全风险。本论文旨在研究网络平台外卖食品安全监管问题的法律规制现状,剖析网络平台外卖食品安全监管在立法维度、行政监管维度、司法维度、消费者维度等方面存在的问题。提出从法律法规体系、监管机制和法律责任制度、消费者权益的保护等四个方面入手,形成全方位、多层次、立体化的法律保障体系,确保外卖食品的安全和质量,保障消费者的合法权益和健康。Online food delivery platforms have become an integral part of public life. With the rapid development of these platforms, the formulation and updating of relevant laws, regulations, and industry standards have relatively lagged behind. The lack of clear guidance and norms for platforms, merchants, and delivery riders in their operations has increased food safety risks. This paper aims to study the current legal regulatory status of food safety supervision in online food delivery platforms, analyzing the issues in the legislative, administrative, judicial, and consumer dimensions of food safety supervision. It proposes to establish a comprehensive, multi-layered, and three-dimensional legal safeguard system from four aspects: the legal and regulatory framework, supervisory mechanisms and legal liability systems, and the protection of consumer rights and interests. This system will ensure the safety and quality of food delivered through online platforms and safeguard the legitimate rights and health of consumers.
